1. Definitions
- “User” refers to any individual or entity accessing or using the Digital Pinoy platform.
- “Freelancer” refers to individuals offering services via the platform.
- “Employer” refers to individuals or entities hiring Freelancers via the platform.
- “Platform” refers to the Digital Pinoy website and associated services.
- “Payment Processor” refers to third-party services used to process payments (e.g., GCash, PayMaya, bank transfers).
2. User Account
To access certain services, you may be required to register for an account. You agree to:
- Provide accurate and complete information during registration.
- Maintain the confidentiality of your account credentials.
- Notify us immediately of any unauthorized use of your account.
Digital Pinoy reserves the right to suspend or terminate your account if we detect any breach of these terms or suspicious activity.
3. Services Provided
Digital Pinoy provides an online platform for freelancers and employers to connect and complete projects. Freelancers offer services, and employers can hire and pay them through the platform.
- Freelancers are responsible for the quality and timely completion of their services.
- Employers are responsible for paying Freelancers promptly upon job completion.
4. Payments
Payments on Digital Pinoy are facilitated through third-party payment processors like bank transfers, GCash, PayMaya, or other supported methods. By using these payment services, you agree to comply with the terms set by the payment processors.
4.1 Payment Collection and Distribution
- Employers must pay the agreed amount through the platform.
- Payment details (e.g., bank account numbers, GCash, or PayMaya details) are collected and used solely for the purpose of payment processing and will be secured in compliance with the Data Privacy Act of 2012.
4.2 Refunds and Disputes
- All refunds, disputes, and chargebacks must be handled through the platform.
- Digital Pinoy will act as a mediator in any disputes but holds no responsibility for the outcome of such disputes.
- Payments once processed are considered final unless a valid refund request is filed and resolved.
5. User Obligations
By using the platform, you agree:
- For Freelancers: To deliver services as described and agreed upon with the Employer.
- For Employers: To make payments for the services rendered, in compliance with the agreed-upon terms.
- Not to use the platform for illegal activities, fraud, or any conduct that violates the rights of other users or third parties.
- To comply with all applicable laws, including the Electronic Commerce Act of 2000 and the Data Privacy Act of 2012.
6. Privacy and Data Protection
We respect your privacy and are committed to protecting your personal data. Our use of your data is governed by the Digital Pinoy Privacy Policy, which complies with the Data Privacy Act of 2012.
- We collect only the necessary personal information to provide our services.
- Payment information is used solely for the purpose of facilitating transactions and is protected by industry-standard encryption technologies.
- We do not store sensitive payment data (e.g., bank account numbers, GCash, PayMaya details) beyond what is necessary to complete the payment process.
7. Intellectual Property
All content, design, trademarks, and technology on the Digital Pinoy platform are the exclusive property of Digital Pinoy or its licensors. Users are not permitted to copy, reproduce, or distribute any content without prior written consent.
8. Limitation of Liability
Digital Pinoy provides its platform on an “as is” and “as available” basis. We do not guarantee that the platform will be free from errors, interruptions, or defects.
- Digital Pinoy is not responsible for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the platform.
- Digital Pinoy does not assume responsibility for the actions or inactions of any Freelancer or Employer.
9. Termination
We reserve the right to suspend or terminate your account or access to our platform at any time, with or without cause or notice, including but not limited to the following:
- Breach of any terms outlined in this agreement.
- Fraudulent, illegal, or unauthorized activity.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, specifically adhering to the Electronic Commerce Act of 2000 and the Data Privacy Act of 2012.
Any disputes arising from these terms shall be resolved in the courts of the Republic of the Philippines.
11. Amendments
We reserve the right to amend or modify these Terms of Service at any time. Any changes will be posted on our website, and continued use of the platform signifies acceptance of the revised terms.
